On April 7, 2015, respondent filed a motion to dismiss the petition. ECF 20 No. 9. Petitioner has not opposed respondent’s motion. Good cause appearing, IT IS HEREBY 21 ORDERED that, within twenty-one days after the filing date of this order, plaintiff shall file and 22 serve an opposition or statement of non-opposition to the pending motion to dismiss. Failure to 23 comply with this order will result in a recommendation that this action be dismissed without 24 prejudice for failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b). 25 DATED: May 19, 2015 26 27 28
