APPROXIMATELY $14,400.00 IN U.S. CURRENCY, 15 Defendant. 16 17 Pursuant to the Stipulation for Final Judgment of Forfeiture, the Court finds: 18 1. This is a civil action in rem to forfeit to the United States Approximately $14,400.00 in 19 U.S. Currency (“defendant currency”) involved in violations of federal drug laws. 20 2. A Verified Complaint for Forfeiture In Rem (“Complaint”) was filed on December 3, 21 2014, alleging that said defendant currency is subject to forfeiture to the United States pursuant to 21 22 U.S.C. § 881(a)(6). 23 3. On December 17, 2014, the Clerk issued a Warrant for Arrest for the defendant 24 currency, and that warrant was duly executed on December 19, 2014. 25 4. Beginning on December19, 2014, for at least 30 consecutive days, the United States 26 published Notice of the Forfeiture Action on the official internet government forfeiture site 27 www.forfeiture.gov. A Declaration of Publication was filed on January 20, 2015. 28 29 30 5. In addition to the public notice on the official internet government forfeiture site 1 Final Judgment of Forfeiture 1 www.forfeiture.gov, actual notice or attempted notice was given to Cliff A. Charpentier. 2 6. Claimant Cliff A. Charpentier filed a claim alleging an interest in the defendant currency 3 on February 23, 2015, and an answer to the Complaint on February 23, 2015. No other parties have 4 filed claims or answers in this matter, and the time in which any person or entity may file a claim and 5 answer has expired. 6 Based on the above findings, and the files and records of the Court, it is hereby ORDERED 7 AND ADJUDGED: 8 1. The Court adopts the Stipulation for Final Judgment of Forfeiture entered into by and 9 between the parties to this action. 10 2. Judgment is hereby entered against claimant Cliff A. Charpentier and all other potential 11 claimants who have not filed claims in this action. 12 3. Upon entry of this Final Judgment of Forfeiture, $6,400.00 of the $14,400.00 in U.S. 13 Currency, together with any interest that may have accrued on the total amount seized, shall be 14 forfeited to the United States pursuant to 21 U.S.C. § 881(a)(6), to be disposed of according to law. 15 4. Upon entry of this Final Judgment of Forfeiture, but no later than 60 days thereafter, 16 $8,000.00 of the $14,400.00 in U.S. Currency shall be returned to claimant Cliff A. Charpentier 17 through his attorney David S. Silber. 18 5. The United States and its servants, agents, and employees and all other public entities, 19 their servants, agents, and employees, are released from any and all liability arising out of or in any way 20 connected with the seizure, arrest, or forfeiture of the defendant currency. This is a full and final 21 release applying to all unknown and unanticipated injuries, and/or damages arising out of said seizure, 22 arrest, or forfeiture, as well as to those now known or disclosed. The parties waived the provisions of 23 California Civil Code § 1542. 24 6. Claimant waived any and all claim or right to interest that may have accrued on the 25 defendant currency. 26 7. All parties are to bear their own costs and attorneys' fees. 27 8. The U.S. District Court for the Eastern District of California, Hon. Garland E. Burrell, 28 Jr., District Judge, shall retain jurisdiction to enforce the terms of this Final Judgment of Forfeiture. 2 Final Judgment of Forfeiture 29 30 1 9. Based upon the allegations set forth in the Complaint filed December 3, 2014, and the 2 Stipulation for Final Judgment of Forfeiture filed herein, the Court enters this Certificate of Reasonable 3 Cause pursuant to 28 U.S.C. § 2465, that there was reasonable cause for the seizure and arrest of the 4 defendant currency, and for the commencement and prosecution of this forfeiture action. 5 6 SO ORDERED.
