Plaintiff Orlando Payne, a state prisoner currently incarcerated at High Desert State

14

Prison (HDSP), filed a pro se civil rights complaint under 42 U.S.C. § 1983 complaining that

15

HDSP staff confiscated his property.

16

The acts complained of in his complaint occurred at HDSP, located in Lassen County

17

which lies in the Eastern District of California. Venue, therefore, properly lies in the Eastern

18

District and not in this one. See 28 U.S.C. § 1391(b).

19

Accordingly, in the interest of justice and pursuant to 28 U.S.C. § 1406(a), this action

20

is TRANSFERRED to the United States District Court for the Eastern District of California.

21

The Clerk of the Court shall transfer the case forthwith.
