By an order filed January 21, 2015, plaintiff was ordered to file an in forma pauperis

affidavit or pay the appropriate filing fees within thirty days and was cautioned that failure to do
19
so would result in a recommendation that this action be dismissed. ECF No. 3. The thirty day
20
period has now expired, and plaintiff has not responded to the court’s order and has not filed an in
21
forma pauperis affidavit or paid the appropriate filing fee. Accordingly, IT IS HEREBY
22
RECOMMENDED that this action be dismissed without prejudice.

These findings and recommendations are submitted to the United States District Judge
24
assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days
25
after being served with these findings and recommendations, plaintiff may file written objections
26
with the court. Such a document should be captioned “Objections to Magistrate Judge’s Findings
27
and Recommendations.” Plaintiff is advised that failure to file objections within the specified
28

time may waive the right to appeal the District Court’s order. Martinez v. Ylst, 951 F.2d 1153

(9th Cir. 1991).
