ORDER U.S. MARSHALS SERVICE, et al., Respondents. 16 17 Petitioner, a federal pretrial detainee proceeding pro se, has filed an application for a writ 18 of habeas corpus pursuant to 28 U.S.C. § 2241. Petitioner has filed an application to proceed in 19 forma pauperis. ECF No. 2. However, the certified copy of his prison trust account statement 20 and the certificate completed by plaintiff’s institution of incarceration were respectively dated 21 five and seven months prior to the submission of the petition. See 28 U.S.C. § 1915(a). 22 Petitioner will be provided the opportunity to submit an updated in forma pauperis application 23 and certified copy of his prison trust account statement in support of his application. 24 In accordance with the above, IT IS HEREBY ORDERED that: 25 1. Petitioner shall submit, within thirty days from the date of this order, an updated 26 affidavit in support of his request to proceed in forma pauperis and a certified copy of his prison 27 trust account statement for the six month period immediately preceding the filing of the petition. 28 Failure to comply with this order will result in a recommendation that this action be dismissed 1 1 2 without prejudice; and 2.
