DENNEHY, et al., 15 Defendants. 16 17 Defendants have filed a motion to stay discovery and modify the scheduling order. ECF 18 No. 22. They state that they will imminently be filing a motion for summary judgment based on 19 plaintiff’s failure to exhaust administrative remedies. Id. at 1. Defendants note that the current 20 scheduling order requires the parties to have served discovery requests by October 23, 2017. Id. 21 at 2. They state that, as of the date the current motion was filed, neither plaintiff nor defendants 22 have served any discovery requests. Id. Consequently, they ask that the deadline for serving 23 discovery requests be extended until sixty days after the court rules on the as yet unfiled motion 24 for summary judgment. Id. Based on the foregoing, the court finds that good cause exists for modification of the 25 26 scheduling order. 27 //// 28 //// 1 1 It is ORDERED that: 2 1. 3 4 5 6 7 8 9 Defendants’ motion to modify the scheduling order and stay discovery (ECF No. 22) is GRANTED; 2. Discovery is stayed pending the filing and adjudication of defendants’ motion for summary judgment; 3. The deadline to serve discovery requests is extended to sixty days from the date the court rules on defendants’ motion for summary judgment; and 4.
