This stipulation is entered into by and between Plaintiffs Nutrishare, Inc., Patient One,

2 Patient Two, and Patient Three (together, “Plaintiffs”) and Defendants Connecticut General Life
3 Insurance Company and CIGNA Health and Life Insurance Company (together, “CIGNA”).

WHEREAS, Plaintiffs and CIGNA have entered into a confidential Settlement Agreement

5 and Release concerning the claims asserted in the above-entitled action;
6

IT IS HEREBY STIPULATED by and between Plaintiffs and CIGNA, through their

7 respective counsel of record, that, Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), the
8 above-entitled action shall be dismissed with prejudice, with each party to bear its own costs
9 and/or attorneys’ fees.
