England, Jr. on 4/23/2015 ORDERING The Court ADOPTS the Stipulation for Final Judgment of Forfeiture entered into by and between the parties to this action; that judgment is hereby ENTERE D against Claimant Stephen Van Horn and allother potential claimants who have not filed claims in this action; Upon entry of this Final Judgment of Forfeiture, $13,400.00 of the Approx. $18,400.00 in US Currency and $2,600.00 in US Cur rency, together with any interest that may have accrued on the total amount seized, shall be forfeited to the US pursuant to 21:881(a)(6), to be disposed of according to law; Upon entry of this Final Judgment of Forfeiture, but no later than 60 days thereafter, $5,000.00 of the Approximately $18,400.00 in US Currency shall be returned to Claimant Stephen Van Horn through his attorney Charles R. Farrar, Jr.; CERTIFICATE OF REASONABLE CAUSE Based upon the allegations set forth in the Com plaint filed 2/17/2015, and the Stipulation for Final Judgment of Forfeiture filed herein, the Court enters this Certificate of Reasonable Cause pursuant to 28:2465, that there was reasonable cause for the seizure and arrest of the defendant currency, and for the commencement and prosecution of this forfeiture action. This is a civil forfeiture action brought against Approximately $18,400.00 in 21 U.S. Currency and Approximately $2,600.00 in U.S. Currency (collectively the “Defendant 22 Currency”), which was seized on or about September 17, 2014. 23 2. A Verified Complaint for Forfeiture In Rem (“Complaint”) was filed on 24 February 17, 2015, alleging that said Defendant Currency is subject to forfeiture to the 25 United States pursuant to 21 U.S.C. § 881(a)(6). 26 3. On February 18, 2015, the Clerk issued a Warrant for Arrest for the 27 Defendant Currency, and that warrant was duly executed on February 18, 2015. 28 29 4. Beginning on March 3, 2015, for at least 30 consecutive days, the United 1 Final Judgment of Forfeiture 1 States published Notice of the Forfeiture Action on the official internet government 2 forfeiture site www.forfeiture.gov. A Declaration of Publication was filed on April 3, 2015. 3 5. In addition to the public notice on the official internet government forfeiture 4 site www.forfeiture.gov, actual notice or attempted notice was given to: 5 a. Stephen Curtis Van Horn 6 b. Jessica Van Skiver 7 6. Claimant Stephen Van Horn included a claim alleging an interest in the 8 Defendant Currency with the Stipulation for Final Judgment of Forfeiture. No other 9 parties have filed claims or answers in this matter, and the time in which any person or 10 entity may file a claim and answer has expired. 11 7. The Clerk of the Court entered a Clerk's Certificate of Entry of Default 12 against Jessica Van Skiver on April 3, 2015. Pursuant to Local Rule 540, the United States 13 and Claimant thus join in a request that as part of this Final Judgment of Forfeiture the 14 Court enter a default judgment against the interests, if any, of Jessica Van Skiver without 15 further notice. 16 Based on the above findings, and the files and records of the Court, it is hereby 17 ORDERED AND ADJUDGED: 18 1. The Court adopts the Stipulation for Final Judgment of Forfeiture entered 19 into by and between the parties to this action. 20 2. That judgment is hereby entered against Claimant Stephen Van Horn and all 21 other potential claimants who have not filed claims in this action. 22 3. Upon entry of this Final Judgment of Forfeiture, $13,400.00 of the 23 Approximately $18,400.00 in U.S. Currency and $2,600.00 in U.S. Currency, together with 24 any interest that may have accrued on the total amount seized, shall be forfeited to the 25 United States pursuant to 21 U.S.C. § 881(a)(6), to be disposed of according to law. 26 4. Upon entry of this Final Judgment of Forfeiture, but no later than 60 days 27 thereafter, $5,000.00 of the Approximately $18,400.00 in U.S. Currency shall be returned 28 to Claimant Stephen Van Horn through his attorney Charles R. Farrar, Jr. 29 2 Final Judgment of Forfeiture 1 5. The United States and its servants, agents, and employees and all other 2 public entities, their servants, agents, and employees, are released from any and all 3 liability arising out of or in any way connected with the seizure, arrest, or forfeiture of the 4 defendant currency. This is a full and final release applying to all unknown and 5 unanticipated injuries, and/or damages arising out of said seizure, arrest, or forfeiture, as 6 well as to those now known or disclosed. The parties waived the provisions of California 7 Civil Code § 1542. 8 6. Claimant waived any and all claim or right to interest that may have accrued 9 on the defendant currency. 10 7. All parties are to bear their own costs and attorneys' fees. 11 8. The U.S. District Court for the Eastern District of California, Hon. Morrison 12 C. England, Jr., District Judge, shall retain jurisdiction to enforce the terms of this Final 13 Judgment of Forfeiture. CERTIFICATE OF REASONABLE CAUSE 14 15 9. Based upon the allegations set forth in the Complaint filed February 17, 2015, 16 and the Stipulation for Final Judgment of Forfeiture filed herein, the Court enters this 17 Certificate of Reasonable Cause pursuant to 28 U.S.C. § 2465, that there was reasonable 18 cause for the seizure and arrest of the defendant currency, and for the commencement and 19 prosecution of this forfeiture action. 20 21 22 IT IS SO ORDERED.
