IT IS HEREBY STIPULATED, by and between the parties, through their respective

counsel of record, that the time for responding to Plaintiff’s Opening Brief be extended from

January 21, 2016 to February 22, 2016. This is Defendant’s first request for an extension of time

23

to respond to Plaintiff’s motion. An extension of time is needed given Defendant counsel’s

24

workload, and in order for counsel to review and respond to the issues raised in Plaintiff’s

25

motion. The parties further stipulate that the Court’s Scheduling Order shall be modified

26

accordingly.
