Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), the parties, by and

5 defendants shall be dismissed with prejudice, each party to bear its own costs and fees. The
6 parties have fully executed the terms of a Release Agreement and dismissal should be granted
7 pursuant to Federal Rule of Civil Procedure 41(a)(2).
