WHEREAS, on March 24, 2016, the Parties lodged with this Court a proposed Consent

Decree, signed by each (Dkt. 13-1) and simultaneously submitted the same to the U.S.

Department of Justice pursuant to the requirements of the Clean Water Act, 33, U.S.C. §
4
1365(c)(3);

WHEREAS, on May 4, 2016, the U.S. Department of Justice filed with this Court a letter
stating that “the United States has no objection the proposed consent decree;” (Dkt. 15)
WHEREAS, the [Proposed] Consent Decree lodged with this Court lacked a signature
line for entry by this Court, which is the desired outcome of this case of each of the Parties;
THEREFORE: Counsel hereby stipulate to entry of the proposed Consent Decree by this
Court on behalf of their respective clients, each of which signed and agreed to be bound by the
terms of the [Proposed] Consent Decree prior to it being filed with this Court and reviewed by
the U.S. Department of Justice.
