ORDER PEOPLE OF THE STATE OF CALIFORNIA, et al., Respondents. 16 17 Petitioner, a state prisoner proceeding pro se, has filed an application for a writ of habeas 18 19 corpus under 28 U.S.C. § 2254. The matter was referred to a United States Magistrate Judge as 20 provided by 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. On February 8, 2016, the magistrate judge filed findings and recommendations, which 21 22 were served on petitioner and which contained notice to petitioner that any objections to the 23 findings and recommendations were to be filed within fourteen days. ECF No. 15. Petitioner has 24 not filed objections to the findings and recommendations. The court presumes that any findings of fact are correct. See Orand v. United States, 25 26 602 F.2d 207, 208 (9th Cir. 1979). The magistrate judge’s conclusions of law are reviewed de 27 novo. See Britt v. Simi Valley Unified School Dist., 708 F.2d 452, 454 (9th Cir. 1983). 28 ///// 1 1 After the magistrate judge issued the findings and recommendations, the United States 2 Court of Appeals for the Ninth Circuit held that completely unexhausted habeas petitions may be 3 stayed if the criteria for a stay under Rhines v. Weber, 544 U.S. 269 (2005) are met. Mena v. 4 Long, _ 5 matter will be referred back to the assigned magistrate judge for further consideration in light of 6 Mena. F.3d _ , 2016 WL 625405 (9th Cir.
