1 2 3 4 5 UNITED STATES DISTRICT COURT 6 NORTHERN DISTRICT OF CALIFORNIA 7 8 JOSEPH DUANE TURNER, 9 United States District Court For the Northern District of California 10 No. C 15-203 SI (pr) Plaintiff, ORDER OF TRANSFER v. 11 CALIFORNIA DEPARTMENT OF CORRECTIONS AND 12 REHABILITATION; et al., 13 Defendants. / 14 15 Plaintiff, an inmate at the Deuel Vocational Institution in Tracy, filed this civil rights 16 action under 42 U.S.C. § 1983, complaining about events and omissions that occurred at that 17 prison, which is located in San Joaquin County. San Joaquin County is within the venue of the 18 Eastern District of California. Some or all of the defendants – a state agency headquartered in 19 Sacramento County and individuals who work at the prison in San Joaquin County – apparently 20 reside in the Eastern District of California. No defendant is alleged to reside in, and none of the 21 events or omissions giving rise to the complaint appears to have occurred in, the Northern 22 District. Venue therefore would be proper in the Eastern District and not in this one. See 28 23 U.S.C. § 1391(b). Accordingly, in the interest of justice and pursuant to 28 U.S.C. § 1406(a), 24 this action is TRANSFERRED to the United States District Court for the Eastern District of 25 California. The clerk shall transfer this matter. 26 27 28 IT IS SO ORDERED. Dated: July 21, 2015 _______________________ SUSAN ILLSTON United States District Judge
