Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42
17

U.S.C. § 1983. The court has determined that this case would benefit from a settlement
19
conference. Both parties have requested the undersigned conduct the settlement conference and
20
waived in writing any claim of disqualification on that basis pursuant to Local Rule 270(b). (ECF
21
Nos. 47, 48.) Therefore, the undersigned will conduct a settlement conference on February 27,
22
2019, at 10:00 a.m., at the Robert T. Matsui Federal Courthouse, 801 I Street, Courtroom 27,
23
Sacramento, California 95814.

Plaintiff shall have the option to appear at the settlement conference in person or by video
25
conference. In the event video conferencing capabilities are unavailable, plaintiff may appear by
26
telephone. Plaintiff will be required to return the attached form advising the court how he would
27
like to appear at the settlement conference so that the court may issue the appropriate orders. A

separate order and writ of habeas corpus ad testificandum will issue once it has been determined
2
how plaintiff will appear.

In accordance with the above, IT IS HEREBY ORDERED that:

1. This case is set for a settlement conference before Magistrate Judge Barnes on
5
February 27, 2019 at 10:00 a.m., at the Robert T. Matsui Federal Courthouse, 801 I Street,
6
Courtroom 27, Sacramento, California 95814.

2. Each party must have a principle with full and unlimited authority to negotiate and
enter into a binding settlement attend. Defendants’ principle must attend in person.
3. Plaintiff shall have the choice to attend the settlement conference in person or by
10
video. Within ten days of this order, plaintiff shall return the attached form notifying the court
11
whether he would like to attend the settlement conference in person or by video. If plaintiff
12
chooses to appear by video and video conferencing is not available, he may appear by telephone.
13
If plaintiff does not return the form telling the court how he would like to attend the conference,
14
the court will issue orders for plaintiff to appear by video.
15
4. Those in attendance must be prepared to discuss the claims, defenses, and damages.
16
The failure of any counsel, party, or authorized person subject to this order to appear in person
17
may result in the imposition of sanctions.
18
5. Each party shall provide a confidential settlement statement to chambers, no later than
19
February 20, 2019, via e-mail to dborders@caed.uscourts.gov. If plaintiff is unable to access the
