Plaintiff proceeds pro se with an action brought pursuant to 42 U.S.C. § 1983, Bivens v.

Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971), and the

19

Federal Tort Claim Act (FTCA). The court dismissed his original complaint and gave plaintiff

20

leave to amend. ECF No. 4. Plaintiff has now moved to voluntarily dismiss this suit. ECF No. 6.

21

Pursuant to Federal Rule of Civil Procedure 41(a), that request will be granted. Accordingly, IT

22

IS HEREBY ORDERED that this action is dismissed without prejudice and the clerk of court

23

shall close this case.
