This action is 17 18 proceeding on plaintiff’s complaint filed on October 5, 2015 against defendants Logan, Thomas, 19 and Nigg for violation of the Eighth Amendment. ECF No. 1. On December 19, 2016, 20 defendants filed a motion to revoke plaintiff’s in forma pauperis status. ECF No. 15. Plaintiff 21 has not filed a response to the motion. Local Rule 230(l) provides in part: “Failure of the 22 responding party to file written opposition or to file a statement of no opposition may be deemed 23 a waiver of any opposition to the granting of the motion . . . .” On October 24, 2016, plaintiff was 24 advised of the requirements for filing an opposition to the motion and that failure to oppose such 25 a motion may be deemed a waiver of opposition to the motion.
