On November 12, 2015, the court ordered plaintiff to file an in forma pauperis affidavit or
18
pay the appropriate filing fee within thirty days and cautioned plaintiff that failure to do so would
19
result dismissal of this action without prejudice. The thirty-day period has now expired, and
20
plaintiff has not responded to the court’s order and has not filed an in forma pauperis affidavit or
21
paid the appropriate filing fee.1
Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court is directed to
22

randomly assign a United States District Judge to this action.

IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice.

These findings and recommendations are submitted to the United States District Judge
