CITY OF LINCOLN, Defendant. 16 17 The Court has received the Notice of Related Case filed on February 6, 2017. 18 Examination of the above-entitled civil actions reveals that the above actions are 19 related to Chapman v. City of Lincoln, 2:17-cv-00123-MCE-EFB, within the meaning of 20 Local Rule 123(a) (E.D. Cal. 1997). The actions involve the same parties and are based 21 on the same or similar claims, the same property transaction or event, similar questions 22 of fact and the same questions of law, and would therefore entail a substantial 23 duplication of labor if heard by different judges. 24 25 26 Accordingly, the assignment of the matters to the same judge is likely to effect a substantial savings of judicial effort and is also likely to be convenient for the parties. The parties should be aware that relating the cases under Local Rule 123 merely 27 has the result that both actions are assigned to the same judge; no consolidation of the 28 action is effected. 1 1 Under the regular practice of this court, related cases are generally assigned to the 2 district judge and magistrate judge to whom the first filed action was assigned. 3 IT IS THEREFORE ORDERED that the action denominated 2:17-cv-00123-KJM- 4 AC is reassigned to District Judge Morrison C. England, Jr. and Magistrate Judge 5 Edmund F. Brennan for all further proceedings, and any dates currently set in 2:17-cv- 6 00123-KJM-AC are hereby VACATED. The Clerk of the Court is to issue the Initial 7 Pretrial Scheduling Order.
