COLVIN, Acting Commissioner of Social Security, Defendant. 15 16 17 On April 18, 2016, plaintiff filed a motion for summary judgment. ECF No. 10. Pursuant 18 to the court’s scheduling order, defendant was required to file an opposition or a statement of 19 non-opposition to plaintiff’s motion, as well as any cross-motions, within 30 days of the date 20 plaintiff’s motion was served. ECF No. 3. On May 19, 2016, defendant timely filed an 21 opposition to plaintiff’s motion. ECF No. 11. Defendant did not, however, file a cross-motion 22 for summary judgment. Without defendant moving for summary judgment, the court is without 23 authority to enter judgment in defendant’s favor should defendant successfully oppose plaintiff’s 24 motion. 25 Accordingly, IT IS HEREBY ORDERED that defendant shall file a cross-motion for 26 summary judgment within 14 days of the date this order is served. 27 DATED: May 19, 2016. 28
