ORDER JEROME PRICE, Warden, 15 Respondent. 16 Petitioner is a state prisoner proceeding pro se and in forma pauperis with a petition for 17 18 writ of habeas corpus pursuant to 28 U.S.C. § 2254. By order filed January 4, 2016, respondent 19 was directed to file a response to the petition. See ECF No. 4. Petitioner now requests 20 appointment of counsel on the grounds that he is indigent and the assistance of counsel would 21 protect his interests. See ECF No. 8. 22 Although there is no absolute right to appointed counsel in habeas proceedings, see 23 Nevius v. Sumner, 105 F.3d 453, 460 (9th Cir. 1996), counsel may be appointed at any stage of a 24 habeas proceeding “if the interests of justice so require,” see 18 U.S.C. § 3006A; Rule 8(c), Fed. 25 //// 26 //// 27 //// 28 //// 1 1 R. Governing § 2254.
