By order filed May 3, 2017, the complaint was dismissed with leave to file an amended

complaint within thirty days. ECF No. 8. Plaintiff requested an extension of time and was
19
granted an additional thirty days to file his amended complaint. ECF Nos. 11, 12. Thirty days
20
have now passed and plaintiff has not filed an amended complaint or otherwise responded to the
21
order.

Accordingly, IT IS HEREBY ORDERED that within twenty-one days after the filing date
23
of this order, plaintiff shall file an amended complaint. Failure to comply with this order will
24
result in a recommendation that this case be dismissed without prejudice for failure to prosecute
25
pursuant to Federal Rule of Civil Procedure 41(b).
