Plaintiff is a state prisoner proceeding pro se and in forma pauperis with a civil rights
17

action pursuant to 42 U.S.C. § 1983. In an order filed February 6, 2018, plaintiff’s second
19
amended complaint was dismissed and plaintiff was given thirty days to file a third amended
20
complaint. (ECF No. 22.) Plaintiff was warned that his failure to comply with the court’s order
21
would result in a recommendation that this action be dismissed. (Id. at 7.)
Thirty days have passed and plaintiff has not filed a third amended complaint or otherwise
22
23
responded to the court’s February 6 order.
Accordingly, the Clerk of the Court is HEREBY ORDERED to randomly assign a district
24
25
judge to this case; and
IT IS RECOMMENDED that this case be dismissed for plaintiff’s failure to prosecute.

These findings and recommendations will be submitted to the United States District Judge

assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days

after being served with these findings and recommendations, plaintiff may file written objections
4
with the court. The document should be captioned “Objections to Magistrate Judge's Findings
5
and Recommendations.” Plaintiff is advised that failure to file objections within the specified
6
time may result in waiver of the right to appeal the district court’s order. Martinez v. Ylst, 951
7
F.2d 1153 (9th Cir. 1991).
