IT IS HEREBY STIPULATED, by and between the parties, through their respective

counsel of record, that Defendant shall have an extension of time to December 9, 2016 to

22

respond to Plaintiff’s opening brief. This is Defendant’s first request for an extension of time.

23

Defendant apologizes for not filing the brief by the due date November 16, 2016. Defendant

24

miscalendared the deadline. Defendant is requesting the additional time to prepare the brief and

25

meet other deadlines, including a responsive brief for a ninth circuit appeal.

26

This request is made in good faith with no intention to unduly delay the proceedings.

27

The parties further stipulate that the Court’s Scheduling Order shall be modified

28

accordingly.
