By order of the District Judge filed April 14, 2017, plaintiff was granted fourteen days in
19
which to file an amended complaint remedying the deficiencies in the first amended complaint
20
with respect to the claim for violation of California Civil Code § 2923.7. That time period has
21
now expired and plaintiff has not filed an amended complaint or otherwise responded to the
22
court’s order.

Accordingly, IT IS HEREBY RECOMMENDED that the second cause of action for
violation of California Civil Code § 2923.7 be dismissed with prejudice.

These findings and recommendations are submitted to the United States District Judge
26
assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days
27
after being served with these findings and recommendations, any party may file written
28
objections with the court and serve a copy on all parties. Such a document should be captioned

“Objections to Magistrate Judge’s Findings and Recommendations.” Failure to file objections

within the specified time may waive the right to appeal the District Court’s order. Martinez v.

Ylst, 951 F.2d 1153 (9th Cir. 1991).
