WELLS FARGO BANK, N.A.; NDEX WEST, L.L.C.; and DOES 1-20, inclusive, 16 MEMORANDUM AND ORDER RE: PLAINTIFF’S REQUEST FOR CLARIFICATION AND DEFENDANT’S MOTION FOR ATTORNEY FEES Defendants. 17 18 On May 16, 2018, this court entered an order granting 19 Wells Fargo’s Motion for Summary Judgment and denying plaintiff’s 20 Motion for Partial Summary Judgment. 21 before the court are plaintiff’s Request for Clarification of 22 this Order (Docket No. 71) and Wells Fargo’s Motion for Attorney 23 Fees (Docket No. 73). 24 I. Wood, 127 F.3d 1187, 1189 (9th Rule 60(a), however, allows only for correction of 16 clerical mistakes or mistakes arising from oversight or omission. 17 Here, the court made no mistakes in its Order of May 16, 2018. 18 Because the court relied extensively upon portions of the 19 Declaration of Meredith Deal in its Order, plaintiff is correct 20 in assuming that the court overruled his objections to those 21 portions of the Declaration. 22 expressly so state, and no clarification of the court’s Order is 23 necessary. 24 II. 25 There was no need for the court to Motion for Attorney Fees On June 1, 2018, after plaintiff had filed the appeal, 26 Wells Fargo filed a Motion for Attorney Fees. 27 Federal Rule of Civil Procedure 54(d) governs the litigation of 28 attorney fee motions and bills of costs. 2 (Docket No. 73.) “If an appeal on the 1 merits of the case is taken, the court may rule on the claim for 2 fees, may defer its ruling on the motion, or may deny the motion 3 without prejudice, directing . . . a new period for filing after 4 the appeal has been resolved.” 5 committee note (1993). 6 discretion, will stay consideration of Wells Fargo’s Motion for 7 Attorney Fees pending the resolution of the appeal. 8 9 Fed.
