Nancy A. Berryhill is now the Acting Commissioner of Social Security. Pursuant to Rule 25(d)
of the Federal Rules of Civil Procedure, Nancy A. Berryhill should be substituted for Acting
Commissioner Carolyn W. Colvin as the defendant in this suit. No further action needs to be

extended until February 24, 2017. This is Defendant’s second request for an

extension of time to file her responsive pleading. Defense counsel requires
3

additional time to continue discussions with the Agency regarding the government’s
position. Plaintiff’s counsel does not object and agrees that all subsequent deadlines
5
should be accordingly extended.
