Furthermore, Defendant 6 James Thum is dismissed with prejudice as an individual defendant in this Action by stipulation 7 of the Parties. Plaintiff’s remaining claims are hereby remanded to the Superior Court of the 8 State of California for the County of Placer for the continued litigation of this Action.
