Plaintiff is proceeding in this action pro se. The action was accordingly referred to the

magistrate judge for pretrial proceedings by E.D. Cal. R. (“Local Rule”) 302(c)(21). It appears

that plaintiff is an inmate in a correctional facility, and accordingly, motions will be governed by
20
Local Rule 230(l).1 Defendants have filed a motion to dismiss. ECF No. 23.

Accordingly, IT IS HEREBY ORDERED that:
