IT IS HEREBY STIPULATED, by and between Defendant NATIONAL RAILROAD

PASSENGER CORPORATION (“AMTRAK” or “Defendant”) and Plaintiff LENARD R.

MATTHEWS, SR. (“MATTHEWS” or “Plaintiff”), (collectively referred to as “the Parties”) as

follows:

WHEREAS, pursuant to the Court’s Minute Order issued on October 15, 2019 [Dkt.

36], the Settlement Conference was set for January 15, 2020 at 9:00 a.m. in Courtroom 25 before

Magistrate Judge Kendall J. Newman;

WHEREAS, pursuant to the Court’s Minute Order issued on December 31, 2019 [Dkt.

37], the Settlement Conference was reset for January 15, 2020 at 10:30 a.m. in Courtroom 25 before

Magistrate Judge Kendall J. Newman;
WHEREAS, the Parties have agreed to private mediation with Susan Feder of Judicate
West in lieu of the Settlement Conference before Magistrate Judge Kendall J. Newman;.

THEREFORE IT IS HEREBY STIPULATED by and between the Parties, through

their respective counsel, that the Parties jointly request that the Court take the Settlement Conference
15
set for January 15, 2020, off calendar and the Parties participate in private mediation.
