IT IS STIPULATED, by and between the parties, through their respective counsel of record,

that the time for Plaintiff to file his Motion for Summary Judgment/Remand be extended thirty (30)

days until February 16, 2017. This is Plaintiff’s first request for an extension of time. Plaintiff’s
19
counsel is unable to prepare Plaintiff’s opening brief in accordance with the current scheduling order
20
due to counsel’s current workload which currently involves an ongoing jury trial in San Joaquin
21
County Superior Court that is expected to last through January 27, 2017.
