Pursuant to the scheduling order, the time 19 has now passed for plaintiff to file a motion for summary judgment and/or motion for remand. 20 Plaintiff has been granted three extensions of time to file a motion for summary judgment; the last 21 extension of time expired on March 29, 2017. The parties were advised in the scheduling order 22 that the court is not responsible for reminding them of scheduling deadlines and that failure to 23 adhere to the schedule may result in sanctions, including dismissal. L.R. 110. Plaintiff also was 24 advised that plaintiff has an affirmative duty to prosecute this action, and that failure to do so may 25 result in a dismissal for lack of prosecution. Fed. R. Civ.
