FOX, Warden, 15 Respondent. 16 Petitioner is a state prisoner, proceeding pro se, with an application for writ of habeas 17 18 corpus pursuant to 28 U.S.C. § 2254. Both parties consented to proceed before the undersigned 19 for all purposes. See 28 U.S.C. § 636(c). On December 30, 2016, respondent filed a motion to 20 dismiss. Petitioner has not filed an opposition to the motion. Local Rule 230(l) provides in part: 21 “Failure of the responding party to file written opposition or to file a statement of no opposition 22 may be deemed a waiver of any opposition to the granting of the motion . . . .” Id.
