Before the Court is the parties’ Joint Stipulation and Second Request for

19 Continuance of August 26, 2021 Status Conference, ECF No. 59. The stipulation
20 was considered without oral argument. Plaintiff is represented by Cody Kennedy
21 and Stanley Saltzman. Defendant is represented by Nathan Austin and Evan
22 Beecher.

The parties state that they reached an agreement through mediation and are

24 currently in the process of drafting a long-form settlement agreement. The parties
25 also state that, once the final settlement agreement has been executed, they will
26 present the Court with a proposed briefing schedule for Plaintiff’s Motions for
27 Preliminary/Final Approval of Class Action Settlement and related Motion for
28 Approval of Attorney Fees, Costs, and Incentive Awards. However, in the

1 meantime, the parties request that the Court continue the status conference
2 scheduled for August 26, 2021 to give them more time to complete the settlement
3 agreement. The Court finds good cause to accept the stipulation.

Accordingly, IT IS HEREBY ORDERED:

The parties’ Joint Stipulation and Second Request for Continuance of

6 August 26, 2021 Status Conference, ECF No. 59, is accepted and entered into the
7 record.

The Court continues the status conference currently set for August

9 26, 2021 to Thursday, September 30, 2021 at 1:30 p.m. by telephone. The
10 parties shall call the Court’s toll-free conference line at [phone] and enter
11 access code 8839796. The parties shall follow the automated instructions to ensure
12 that they are added to the conference in a timely manner.

On or before September 27, 2021, the parties shall submit a joint

14 status certificate, proposing a new briefing schedule for approval of class action
15 settlement and attorneys’ fees.

IT IS SO ORDERED. The Clerk of Court is directed to enter this Order

17 and forward copies to counsel.
