Plaintiff filed a Complaint acting in pro se alleging False Claims act charges against
18
defendants on September 22, 2016. ECF No. 1. On February 6, 2017, the undersigned entered
19
Findings and Recommendations in which dismissal of the complaint with prejudice, ECF No. 21,
20
which recommendation was adopted by the district court on March 16, 2017, ECF 23, and
21
judgment was entered on the same date. ECF No. 24. Plaintiff filed a Notice of Appeal on April
22
10, 2017, ECF No. 25, together with a Motion to Proceed In Forma Pauperis. ECF No. 26. This
23
Order addresses the Motion.

The Court has examined the affidavit executed by plaintiff in conjunction with his Motion
25
and finds that the appeal is not brought in good faith. As a result, the court will DENY this
26
Motion.

In light of the foregoing IT IS THEREFORE ORDERED THAT:

Plaintiff’s Motion to Proceed In Forma Pauperis is DENIED;
