Petitioner, a state prisoner proceeding pro se, has filed an application for a writ of habeas

18

corpus pursuant to 28 U.S.C. § 2254. Petitioner has not, however, filed a signed affidavit to

19

proceed in forma pauperis or paid the required filing fee ($5.00). See 28 U.S.C. §§ 1914(a);

20

1915(a). Petitioner will be provided the opportunity to submit either a signed affidavit in support

21

of his request to proceed in forma pauperis or the appropriate filing fee.

In accordance with the above, IT IS HEREBY ORDERED that:

23

1. Petitioner’s previously filed motions to proceed in forma pauperis, ECF Nos. 2 and 4,

24

are denied without prejudice (the exhibits attached to the motions will continue to be duly

25

considered).

2. Petitioner shall, within thirty (30) days after the filing date of this order, submit a

27

signed affidavit in support of his request to proceed in forma pauperis on the form provided

28

herewith, or the appropriate filing fee.
