ORDER CALIFORNIA MEDICAL FACILITY, 15 Respondent. 16 17 Petitioner, a state prisoner proceeding without counsel, has filed a petition for a writ of 18 habeas corpus pursuant to 28 U.S.C. § 2254, together with an application to proceed in forma 19 pauperis. 20 Petitioner challenges his conditions of confinement at the California Medical Facility 21 (“CMF”). For example, petitioner alleges that he suffers back pain because of an improper 22 mattress. The purpose of a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 is to 23 challenge the legality or validity of a conviction or sentence. The purpose of a civil rights action 24 pursuant to 42 U.S.C. § 1983 is to challenge conditions of confinement. Because petitioner 25 challenges conditions of confinement, this action is construed as a civil rights action pursuant to 26 42 U.S.C. § 1983. 27 28 Accordingly, the petition is dismissed with thirty days to file a complaint on the complaint form provided by the Clerk of the Court. Following receipt of the complaint, the court will 1 1 evaluate petitioner’s application to proceed in forma pauperis. 2 Accordingly, IT IS HEREBY ORDERED that: 3 1.
