Presently pending before the court is plaintiff’s motion for leave to proceed in forma

pauperis pursuant to 28 U.S.C. § 1915.1 (ECF No. 2.) The affidavit in support of the motion

20

indicates that plaintiff’s gross wages are $4,300.00 per month, i.e., $51,600.00 annually.

According to the United States Department of Health and Human Services, the poverty guideline

22

for a household of 1 person not residing in Alaska or Hawaii is $12,060.00 for 2017.2 See

23

https://aspe.hhs.gov/poverty-guidelines. Thus, plaintiff’s gross household income is well in

24

excess of 400% of the 2017 poverty guideline. Additionally, although plaintiff is still making

25

mortgage payments and has additional debts and expenses, she is the owner of a home with an

approximate value of $350,000.00. Finally, plaintiff also notes that she received a total of

2

$25,094.19 in Workers’ Compensation payments between August and December of 2016, and an

3

additional $2,000 per month in State Disability payments between May and August of 2016, on

4

top of her gross wages.

Presently, a filing fee of $400.00 is required to commence a civil action in this court. The

6

court may authorize the commencement of an action “without prepayment of fees or security

7

therefor” by a person that is unable to pay such fees or provide security therefor. 28 U.S.C. §

8

1915(a)(1). Here, the court cannot find that plaintiff is unable to pay, or provide security for, the

9

court filing fee. To be sure, the court is sympathetic to the fact that plaintiff does not have a large

10

income by any measure, and that plaintiff also has several expenses to contend with. However,

11

numerous litigants in this court have significant monthly expenditures, and may have to make

12

difficult choices as to which expenses to incur, which expenses to reduce or eliminate, and how to

13

apportion their income between such expenses and litigating an action in federal court. Such

14

difficulties in themselves do not amount to indigency.

Accordingly, IT IS HEREBY ORDERED that:

should such an extension be necessary.

Plaintiff’s motion to proceed in forma pauperis (ECF No. 2) is denied.
