BARRETTO, et al., Defendants. 16 17 Plaintiff is a state prisoner proceeding pro se with a civil rights action under 42 U.S.C. § 18 1983. Plaintiff filed his original complaint in this case on March 17, 2017. (ECF No. 1.) On 19 June 20, 2017, plaintiff filed a first amended complaint. (ECF No. 10.) On July 17, 2017, 20 plaintiff filed a document in which he states that the first amended complaint was filed in this 21 action in error. (ECF No. 12.) Plaintiff states that he meant to file a new action with that 22 complaint and wanted to notify the court that the cases are related. 23 Accordingly, it is HEREBY ORDERED as follows: 24 1. Plaintiff’s motion (ECF No. 12) to strike the first amended complaint (ECF No. 10) 25 from this action is granted; and 26 2. The Clerk of the Court is directed to strike the first amended complaint (ECF No. 10) 27 from this action and open a new case with that filing. The new case shall be assigned 28 to the same district judge and magistrate judge as the present case.
