Plaintiff requests an extension of thirty (30) days for Plaintiff’s counsel to draft
and file a reply to Plaintiff’s motion for summary judgment.

Due to the Court’s requiring immediate filing of motions for summary judgment in
21
the Williams and Smith matters by March 26, 1018 before the Court, Plaintiff believes more
22
time is needed to review the Frizzell administrative record and draft his motion for summary
23
judgment. The parties request this extension in good faith with no intent to unduly prolong
24
proceedings.

Defendant does not object to allowing Plaintiff the additional time to draft his
26
motion for summary judgment and, subject to the Court’s approval, stipulates to thirty
27
(30) days extension of time to allow Plaintiff to file his motion for summary judgment in
28
