The Court has received the Notice of Related Case filed on July 25, 2017.
25
Examination of the above-entitled civil actions reveals that these actions are
26
related within the meaning of Local Rule 123(a) (E.D. Cal. 1997).
27
///
28
1
1
The actions involve many of the same defendants and are based on the same or similar
2
claims, the same property transaction or event, similar questions of fact and the same
3
questions of law, and would therefore entail a substantial duplication of labor if heard by
4
different judges.
5
6
7
Accordingly, the assignment of the matters to the same judge is likely to effect a
substantial savings of judicial effort and is also likely to be convenient for the parties.
The parties should be aware that relating the cases under Local Rule 123 merely
8
has the result that both actions are assigned to the same judge; no consolidation of the
9
action is effected. Under the regular practice of this court, related cases are generally
10
assigned to the district judge and magistrate judge to whom the first filed action was
11
assigned.
12
IT IS THEREFORE ORDERED that the action denominated 2:17-cv-01492-JAM-
13
KJN is reassigned to District Judge Morrison C. England, Jr. and Magistrate Judge
14
Kendall J. Newman for all further proceedings, and any dates currently set in 2:17-cv-
15
01492-JAM-KJN are hereby VACATED. The Clerk of the Court is to issue the Initial
16
Pretrial Scheduling Order. Henceforth, the caption on documents filed in the reassigned
17
case shall be shown as 2:17-cv-01492-MCE-KJN.
18
19
IT IS FURTHER ORDERED that the Clerk of the Court make appropriate
adjustment in the assignment of cases to compensate for this reassignment.
20
IT IS SO ORDERED.
