This case contains claims that are ripe for trial. 1 (ECF No. 74). However, given the

parties’ representations in the joint status report that they will not be ready to proceed to trial until

19

the summer of 2024 at the earliest (ECF No. 78), and given the undersigned’s upcoming

20

retirement in February 2024, the court refrains from scheduling the pretrial conference and trial

21

dates at this time. Instead, the parties are instructed to file an updated trial-readiness report, with

22

proposed dates, for the incoming magistrate judge’s consideration. This report shall be filed by

23

February 15, 2024.
