Plaintiff, a state prisoner proceeding pro se, is attempting to pursue a civil rights action
16

pursuant to 42 U.S.C. § 1983. By order filed September 15, 2017, the court directed plaintiff to
18
file a complaint and an application to proceed in forma pauperis or to pay the filing fee. See ECF
19
No. 3.
On September 26, 2017, plaintiff filed two one-page documents construed by the Clerk of
20
21
Court, respectively, as a motion to proceed in forma pauperis, ECF No. 6, and a motion for
22
appointment of counsel, ECF No. 7. Neither filing is adequate in form or substance, and the latter
23
is premature. Therefore both “motions” will be denied without prejudice and plaintiff will again
24
be directed to file: (1) a complaint, and (2) a proper application to proceed in forma pauperis or
25
to pay the required filing fee of $350.00 plus the $50.00 administrative fee ($400.00 total).1 See
26

If leave to file in forma pauperis is granted, plaintiff will still be required to pay the filing fee
but will be allowed to pay it in installments. Litigants proceeding in forma pauperis are not
required to pay the $50.00 administrative fee.

In accordance with the above, IT IS HEREBY ORDERED that:

1. Plaintiff’s motion to proceed in forma pauperis, ECF No. 6, and motion for

appointment of counsel, ECF No. 7, are denied without prejudice.

that this action be dismissed.
