Defendants.

17
Plaintiff is a state prisoner proceeding with a civil rights action under 42 U.S.C. § 1983.
18
Plaintiff alleges he was subjected to excessive force when a defendant closed a mechanical door
19
on him. He further alleges defendants were deliberately indifferent to his need for medical care.
20
On September 28, 2021, defendants filed a motion to compel plaintiff to respond to defendants’
21
discovery requests. Plaintiff’s response to that motion was due within twenty-one days after
22
service of the motion. (See June 1, 2021 Order (citing E.D. Cal. R. 230(l)).)
23
Twenty-one days have passed and plaintiff has not filed any response to the motion to
24
compel. Local Rule 230(l) provides that a party’s failure to respond to a motion to compel may
25
be deemed a waiver of any opposition to the motion. Plaintiff will be given an opportunity to
26
explain why he has failed to file a timely response to the motion and why defendants’ motion
27
should not be granted.
