The matter was referred to a United States Magistrate Judge pursuant to Local Rule
302(c)(19).

On December 28, 2017, the magistrate judge filed findings and recommendations herein
20
which were served on all parties and which contained notice to all parties that any objections to
21
the findings and recommendations were to be filed within twenty one days. ECF No. 24. Neither
22
party has filed objections to the findings and recommendations.

The court has reviewed the file and finds the findings and recommendations to be
24
supported by the record and by the magistrate judge’s analysis. Accordingly, IT IS HEREBY
25
ORDERED that:
26
1. The findings and recommendations filed December 28, 2017, are adopted in full;
27
2. The Clerk’s Entry of Default (ECF No. 18) is VACATED and SET ASIDE;

3. Plaintiff’s motion for default judgment (ECF No. 19) is DENIED; and
