ORDER AND FINDINGS AND
RECOMMENDATIONS
Defendant.
16
Plaintiff is a state prisoner, proceeding pro se. Plaintiff’s complaint was filed with the
17
18
court on September 25, 2017. The court’s own records reveal that on September 8, 2017, plaintiff
19
filed a complaint containing virtually identical allegations. (2:17-cv-1869 EFB).1 Except for the
20
proof of service on page 8 filed in the earlier action, the instant complaint appears to be a copy of
21
the complaint filed in 2:17-cv-1869 EFB, and both complaints were signed on September 5, 2017.
22
Indeed, the complaint filed in the instant action bears plaintiff’s note at the top of page one:
23
“Inmate’s Copy -- Returned Filed.” (ECF No. 1 at 1.) Due to the duplicative nature of the
24
present action, the court recommends that the complaint in this case be dismissed.
In addition, because it appear plaintiff may have intended his request to proceed in forma

Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court is directed to:

IT IS RECOMMENDED that this action be dismissed without prejudice. See Fed. R. Civ.
P. 41(b).
These findings and recommendations are submitted to the District Judge assigned to this

case pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days after being served

with these findings and recommendations, plaintiff may file written objections with the court.

The document should be captioned “Objections to Magistrate Judge’s Findings and

may waive the right to appeal the District Court’s order. Martinez v. Ylst, 951 F.2d 1153 (9th
