I. 19 The Petition Petitioner challenges the October 17, 2014 decision by the Board of Parole Hearings 20 21 (BPH) denying him parole.1 ECF No. 1 at 1; ECF No. 2 at 10-17, 69. He asserts that his due 22 process rights were violated when the BPH failed to give proper weight to the evidence before it. 23 Id. at 81-89. He also alleges that the BPH violated his rights when it refused to set a primary, or 24 maximum, term as required by In re Rodriguez, 14 Cal. 3d 639 (Cal. 1975), and violated the 25 26 27 1 The petition was initially filed with the Ninth Circuit Court of Appeals as an application to file a second or successive habeas petition. Id. 28 1 1 settlement agreement in In re Butler (Butler I), 236 Cal. App. 4th 1222 (Cal. Ct. App. 2015), 2 when it set his base term at nineteen years then denied him parole even though he had already 3 been in prison for more than nineteen years. ECF No. 2 at 69, 71. 4 II. Discussion 5 Rule 4 of the Habeas Rules Governing Section 2254 Cases requires the court to 6 summarily dismiss a habeas petition “[i]f it plainly appears from the petition and any attached 7 exhibits that the petitioner is not entitled to relief in the district court.” For the reasons explained 8 below, the petition fails to state a cognizable claim for relief and will be dismissed. 9 The United States Supreme Court in 2011 overruled a line of Ninth Circuit precedent that 10 had supported habeas review of parole denials in California cases. Swarthout v. Cooke, 562 U.S. 11 216, 219 (2011). The Supreme Court held that federal habeas jurisdiction does not extend to 12 review of the evidentiary basis for state parole decisions. Id. Because habeas relief is not 13 available for errors of state law, and because the Due Process Clause does not require correct 14 application of California’s “some evidence” standard for denial of parole, federal courts may not 15 intervene in parole decisions as long as minimum procedural protections are provided. Id. at 219- 16 20. The protection afforded by the federal Due Process Clause to California parole decisions 17 consists solely of the “minimum” procedural requirements set forth in Greenholtz v. Inmates of 18 Nebraska Penal and Correctional Complex, 442 U.S. 1 (1979). Cooke, 562 U.S. at 220. 19 Specifically, that petitioner was provided with “an opportunity to be heard and . . . a statement of 20 the reasons why parole was denied.” Id. (citing Greenholtz, 442 U.S. at 16). 21 The transcript attached to the petition makes clear that petitioner was present at the 22 hearing, represented by counsel, and provided a statement of the reasons parole was denied. ECF 23 No. 2 at 104-268. “[T]he beginning and the end of the federal habeas courts’ inquiry” is whether 24 petitioner received “the minimum procedures adequate for due-process protection.” Cooke, 562 25 U.S. at 220. The Ninth Circuit has acknowledged that after Cooke, substantive challenges to 26 parole decisions are not cognizable in habeas. Roberts v. Hartley, 640 F.3d 1042, 1046 (9th Cir. 27 2011). Petitioner received all the process he was due and his challenge to the denial of parole is 28 therefore not cognizable. 2 1 With respect to petitioner’s claims that the Board has failed to set a primary term as 2 required by Rodriguez and to adhere to the terms of the settlement in Butler I, he has also failed 3 to viable claims for relief. “[I]t is not the province of a federal habeas court to reexamine state- 4 court determinations on state-law questions.” Estelle v. McGuire, 502 U.S. 62, 67-68 (1991); 5 Middleton v. Cupp, 768 F.2d 1083, 1085 (9th Cir. 1985) (habeas relief “is unavailable for alleged 6 error in the interpretation or application of state law”). This includes the interpretation or 7 application of state sentencing laws. Miller v. Vasquez, 868 F.2d 1116, 1118-19 (9th Cir. 1989) 8 (declining to address “[w]hether assault with a deadly weapon qualifies as a ‘serious felony’ 9 under California’s sentence enhancement provisions [because it] is a question of state sentencing 10 law”). Accordingly, to the extent petitioner is alleging that the state failed to follow or 11 inappropriately applied state laws, his claims for relief fail. 12 Furthermore, the requirements of Rodriguez and Butler I are not applicable to petitioner’s 13 case. With respect to Rodriguez’ requirement that the BPH set a maximum term for 14 indeterminately sentenced prisoners, this requirement applied to prisoners sentenced prior to the 15 state’s 1976 adoption of “a mostly ‘determinate’ sentencing regime,” and “was not 16 constitutionally required for the ‘narrower category’ of serious offenders who receive 17 indeterminate sentences under current law.” In re Butler (Butler II), 4 Cal. 5th 728, 733, 744-45 18 (Cal. 2018) (emphasis in original) (citing In re Dannenberg, 34 Cal. 4th 1061, 1077-78, 1097 19 (Cal. 2005)). Petitioner committed his offense in 1987 and was convicted and sentenced in 1988 20 (ECF No. 2 at 59, 70, 346-47, 404), after the change in the state’s sentencing laws. As for the 21 requirements of the settlement agreement in Butler I, the California Supreme Court recently held 22 that the BPH is no longer required to set base and adjusted base terms because changes in the 23 state sentencing law “dictate that base terms no longer directly control the release date for 24 prisoners subject to indeterminate sentences.” Butler II, 4 Cal. 5th at 747. Moreover, contrary to 25 petitioner’s claim, even if base and adjusted base terms were still required, “base term 26 calculations were designed to set forth an inmate’s minimum sentence, not to reflect the maximum 27 sentence permitted by the Constitution.” Id. at 746 (emphasis in original). 28 To the extent petitioner contends that the failure to release him violated his due process 3 1 rights and the Eight Amendment’s prohibition of cruel and unusual punishment because he has 2 served more than the nineteen-year base term established by the Board, he fails to state a claim. 3 With respect to the due process portion of petitioner’s argument, it is established that 4 “[t]here is no right under the Federal Constitution to be conditionally released before the 5 expiration of a valid sentence, and the States are under no duty to offer parole to their prisoners.” 6 Cooke, 562 U.S. at 220 (citing Greenholtz, 442 U.S. at 7). If state law does create a liberty 7 interest in parole, “[w]hatever liberty interest exists is . . . a state interest.” Id. (emphasis in 8 original). Due process is satisfied as long as the state provides an inmate seeking parole with “an 9 opportunity to be heard and . . . a statement of the reasons why parole was denied.” Id. (citing 10 Greenholtz, 442 U.S. at 16). As already addressed, the petition and exhibits establish that 11 petitioner was afforded at least the minimal procedures required to satisfy due process. ECF No. 12 2 at 104-268. 13 As for petitioner’s Eighth Amendment claim, a criminal sentence that is “grossly 14 disproportionate” to the crime for which a defendant is convicted may violate the Eighth 15 Amendment. Lockyer v. Andrade, 538 U.S. 63, 72 (2003); Rummel v. Estelle, 445 U.S. 263, 271 16 (1980). However, outside of the capital punishment context, the Eighth Amendment prohibits 17 only sentences that are extreme and grossly disproportionate to the crime. United States v. Bland, 18 961 F.2d 123, 129 (9th Cir. 1992) (quoting Harmelin v. Michigan, 501 U.S. 957, 1001 (1991) 19 (Kennedy, J., concurring)). Such instances are “exceedingly rare” and occur in only “extreme” 20 cases. Andrade, 538 U.S. at 73; Rummel, 445 U.S. at 272. “A punishment within legislatively 21 mandated guidelines is presumptively valid.” United States v. Mejia–Mesa, 153 F.3d 925, 930 22 (9th Cir. 1998) (citing Rummel, 445 U.S. at 272). “‘Generally, so long as the sentence imposed 23 does not exceed the statutory maximum, it will not be overturned on eighth amendment 24 grounds.’” Id. (quoting United States v. McDougherty, 920 F.2d 569, 576 (9th Cir. 1990)). 25 The United States Supreme Court has held that a life sentence is constitutional, even for a 26 non-violent property crime. See Rummel, 445 U.S. at 265-66 (upholding a life sentence with the 27 possibility of parole, imposed under a Texas recidivist statute, for a defendant convicted of 28 obtaining $120.75 by false pretenses, an offense normally punishable by imprisonment for two to 4 1 ten years); see also Harmelin, 501 U.S. at 961, 994-96 (upholding a sentence of life without the 2 possibility of parole for a defendant convicted of possessing more than 650 grams of cocaine, 3 although it was his first felony offense). A life sentence for second degree murder, petitioner’s 4 commitment offense, therefore does not constitute cruel and unusual punishment under the Eighth 5 Amendment. United States v. LaFleur, 971 F.2d 200, 211 (9th Cir. 1991) (“Under Harmelin, it is 6 clear that a mandatory life sentence for murder does not constitute cruel and unusual 7 punishment.” (citing Harmelin, 501 U.S. at 1005)). Accordingly, petitioner’s claim of cruel and 8 unusual punishment must be dismissed. 9 III. 10 Certificate of Appealability Pursuant to Rule 11 of the Federal Rules Governing Section 2254 Cases, this court must 11 issue or deny a certificate of appealability when it enters a final order adverse to the applicant. A 12 certificate of appealability may issue only “if the applicant has made a substantial showing of the 13 denial of a constitutional right.” 28 U.S.C. § 2253(c)(2). For the reasons set forth in these 14 findings and recommendations, a substantial showing of the denial of a constitutional right has 15 not been made in this case. Therefore, no certificate of appealability should issue. 16 Accordingly, IT IS HEREBY RECOMMENDED that: 17 1. The petitioner’s application for writ of habeas corpus be dismissed. 18 2. This court decline to issue the certificate of appealability referenced in 28 U.S.C. 19 § 2253. 20 These findings and recommendations are submitted to the United States District Judge 21 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within twenty-one days 22 after being served with these findings and recommendations, petitioner may file written 23 objections with the court. Such a document should be captioned “Objections to Magistrate 24 Judge’s Findings and Recommendations.” Petitioner is advised that failure to file objections 25 //// 26 //// 27 //// 28 //// 5 1 within the specified time may waive the right to appeal the District Court’s order.
