This miscellaneous case was before the court on August 30, 2017, for hearing on

defendant Denise Rubino’s motion for contempt and sanctions, which the court construes as a

motion to compel non-party Dan Wiemer to comply with a subpoena. ECF No. 1. Attorney

Katharine Tremblay appeared on behalf of defendant; no appearance was made by Dan Wiemer.

For the reasons stated on the record, defendant’s motion (ECF No. 1) is denied without

prejudice to renewal.
