The matter was referred to a United States Magistrate 19 Judge pursuant to Eastern District of California local rules. On September 16, 2021, the Magistrate Judge filed findings and recommendations 20 21 herein which were served on the parties and which contained notice that the parties may file 22 objections within the time specified therein. The court construes petitioner’s subsequent filings 23 (ECF Nos. 44 and 45) as timely objections to the findings and recommendations. 24 In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C) and Local Rule 304, 25 this Court has conducted a de novo review of this case. Having carefully reviewed the entire file, 26 the Court finds the findings and recommendations to be supported by the record and by proper 27 analysis. 28 /// 1 1 Accordingly, IT IS HEREBY ORDERED that: 2 1. The findings and recommendations filed September 16, 2021, are adopted 4 2. Respondent’s motion to dismiss, ECF No. 30, is granted; 5 3.
