FINDINGS AND RECOMMENDATIONS
Respondent.
16
Petitioner, a state prisoner proceeding pro se, brings this petition for a writ of
17
18
habeas corpus pursuant to 28 U.S.C. § 2254. On October 28, 2021, the District Judge issued an
19
order granting Respondent’s motion to dismiss and dismissing Petitioner’s first amended petition
20
with leave to amend. See ECF No. 46. Petitioner was directed to file a second amended petition
21
within 30 days. See id. Petitioner has been warned that failure to comply with court orders may
22
result in dismissal of this action. See Local Rule 110. To date, despite having been granted an
23
extension of time, Petitioner has not complied by filing a second amended petition which is
24
sufficient to proceed consistent with the District Judge’s order dismissing the first amended
25
petition for failure to comply with Rule 2(c) of the Federal Rules Governing Section 2254 Cases.
26
While Petitioner filed a document on January 3, 2022, which has been docketed as a second
27
amended petition, this pleading also fails to comply with Rule 2(c).

7
objections with the court. Responses to objections shall be filed within 14 days after service of
8
objections. Failure to file objections within the specified time may waive the right to appeal.
