In the operative first 19 amended complaint filed on October 1, 2021, plaintiff alleges defendant, an officer at the Yuba 20 County jail, used unconstitutionally excessive force on March 17, 2020, while plaintiff was 21 civilly detained at the jail. (See ECF No. 12.) 22 On May 16, 2023, the undersigned ordered that limited purpose counsel be appointed for 23 plaintiff, subject to an attorney accepting the request for voluntary assistance. (ECF No. 65.) 24 Discovery was stayed pending further order of this court. 25 Unfortunately, the court’s Pro Bono Program has not been able to locate an attorney to 26 provide voluntary assistance to plaintiff. District courts lack authority to require counsel to 27 represent indigent litigants in section 1983 cases. Mallard v. United States Dist.
